Texas Public Policy Foundation and Texas Landowners Win Victory in Fifth Circuit Court Against U.S. Fish & Wildlife Service

In June 2017, the Texas Public Policy Foundation filed a lawsuit to remove the golden-cheeked warbler from the endangered species list based on a 2015 study by the Texas A&M Natural Resources Institute. The A&M research found that the species’ population had grown 19 times and habitat (cedar trees) had increased five times since its 1990 endangerment designation. As long as the warbler remains on the list, landowners whose property includes their habitat will continue to face burdensome government regulations. In January 2020, the Fifth Circuit Court found significant evidence that the warbler should be delisted and ruled unanimously that the U.S. Fish and Wildlife Service must re-evaluate the warbler’s status, providing hope that this regulatory burden will soon be lifted from the backs of property owners across Texas.
